Terms of Use Agreement for Joust

1. Introduction

By accessing or using Joust's services, you agree to be bound by this Terms of Use Agreement ("Terms" or "Agreement"), including our Privacy Policy, Cookie Policy, and Safety Guidelines. Please read this Agreement and these policies carefully before creating an account.

2. Account Eligibility and Responsibilities

You must be at least 18 years old and legally qualified to enter a binding contract to use Joust. By creating an account, you represent that you meet these requirements and agree to:

• Use the latest version of the Joust app.
• Treat other users respectfully, both on and off the app.
• Maintain a strong password and protect your login information.

You agree not to:

• Misrepresent your identity or affiliations.
• Use the service for any illegal or harmful purposes.
• Harass or defame other users.
• Share any Prohibited Content (see below).

3. Content

Your Content

You are responsible for any content you provide on Joust. Ensure that your content is appropriate and does not violate this Agreement.

Prohibited Content

Content that is offensive, obscene, abusive, discriminatory, or promotes illegal activities is prohibited. Sharing such content may result in the suspension or termination of your account.

4. Privacy

For information on how we collect, use, and share your personal data, please read our Privacy Policy. By using Joust, you agree to the use of your data in accordance with this policy.

5. Purchases and Subscriptions

Joust offers various subscription plans and virtual items. By purchasing, you agree to the pricing and terms disclosed at the time of purchase. Subscriptions automatically renew until canceled.

6. Refunds

Generally, all purchases are non-refundable, except as required by law. For specific refund policies applicable to certain jurisdictions, please refer to the detailed terms provided in this section.

7. Account Termination

You may delete your account at any time. Joust reserves the right to terminate your account without notice if you violate these Terms.

8. Dispute Resolution

Disputes will be resolved through binding arbitration or small claims court, except for individual claims of sexual assault or harassment. You waive the right to participate in class actions.

9. Indemnity

You agree to indemnify Joust against any claims arising from your use of the service, your content, or your breach of this Agreement.

10. Governing Law

This Agreement is governed by the laws of Ontario, Canada, without regard to its conflict of laws principles.

11. Entire Agreement

This Agreement constitutes the entire agreement between you and Joust regarding the use of our services and supersedes any prior agreements.
